Q. What is the Compliance and Enforcement Review?

In 2009 and 2010, EPA has been the subject of external reviews that have found our regulatory approach inadequate - a key recommendation is that a higher priority should be given to compliance and enforcement. This review is part of a wider reform program at EPA and we are already well under way reshaping our licensing system, works approval processes, pollution response service and knowledge management capabilities.

Q. Who is leading the review?

Stan Krpan is a consultant engaged by the Environment Protection Authority to undertake a comprehensive and independent review of its approach to compliance and enforcement. Stan is a lawyer by training specialising in criminal law. He has practised in private, community and government settings. Stan was a prosecutor with WorkSafe Victoria and undertook some of Australia's most signficant OHS prosecutions.

For 5 years he was the Director of Legal Services & Investigations for WorkSafe - being responsible for WorkSafe's investigation and prosecution activity. He has been involved in major reforms of WorkSafe's approach to regulation, enforcement and prosecution. He has also been a key leader in the harmonisation of OHS laws and approaches nationally. From December 2009 to June 2010, Stan was WorkSafe's Acting Executive Director of Health and Safety. He has a Masters in Criminal Law and Litigation and has undertaken post-graduate research in the area of regulation and enforcement.

Q. What is the purpose of the Compliance and Enforcement Review Discussion Paper?

It is to promote discussion with all our stakeholders and to generate input from the community and business. The paper poses a series of questions that are designed  to help in the development of:

  • EPA's regulatory approach
  • EPA's new Compliance and Enforcement Policy
  • methods for ensuring transparency and accountability in how we take enforcement action

The discussion forum will close on Friday 22 October - 1 week after the last community forum held in Bendigo.
